Judges are not supposed to make law. If the law on the books does not prohibit the behavior, then it is legally unjustifiable for a court to find that behavior illegal. From what this judges said, they would probably support an amendment to the existing statute to make such actions illegal, but they are doing the responsible thing by interpreting existing law to the best of their ability, regardless of their personal -- or even professional -- opinions about what the law should say.
I can't find anything whatsoever wrong with the court decision. I can find plenty of fault with the law.
