Basically the law hasn't caught up and in many cases the person who's had fraud committed with their identity is presumed to be the guilty party. Check out Clark Howard's site for more information on the fun you can be in for if someone pretends to be you.

But this wasn't identity theft. It was just law-enforcement idiocy -- people assuming a computer match can't be wrong, even if it's based only on last name (the first names were different) and birthdate. Why would someone try to conceal his identity by lying about his first name but giving his real birthdate and last name?
